Terms and Conditions
Legal Services NYC (“LSNYC,” “we” or “us”)offers a Text Program(“Program”) that provides appointment confirmations and referrals to our clients (“Services Texts”). By signing up for the Program, you agree to these terms and conditions (“Program Terms”) and acknowledge our practices described herein and in our Access Line Text Message Privacy Policy below. By signing up, you also authorize LSNYC to deliver to the designated mobile phone number (registered or used to opt-in via short code), appointment confirmation messages or referrals to other legal services providers, including via an autodialer (i.e., automated dialing technology).
You are not required to accept these Program Terms as a condition of receiving legal services and no legal services are necessary to subscribe to the Program. If you do agree, you consent to receiving one text message plus additional non-promotional texts if you interact further with our organization. You understand and accept that short-form descriptions of Program message caps (e.g., “up to 1 msg/mo”) refer only Services Texts and not to messages responding to your HELP requests). Further, you consent to receive electronic records (e.g., Services Texts and these Program Terms) by subscribing to the Program, and in order to withdraw your consent you should follow the unsubscribe process outlined below, at any time. If you unsubscribe you will be removed from the Program. Your consent to receive electronic records (e.g., Services Texts) only applies to this Program. In order to update your contact information, follow the instructions below. You may obtain paper copies of electronic records by contacting us at 917-661-4500. Phones must be able to receive text messages in order to receive electronic records.
You can unsubscribe from the Program by texting “STOP” as a reply to a Program text you receive. You can also unsubscribe by calling us at 917-661-4500. You hereby consent to receive a text message confirming that you have unsubscribed, as well as other non-promotional text messages (such as when you text the short code to join or send us a HELP text or any unrecognized message, and when we send you administrative messages such as if we change the short code).
You agree to promptly notify us if your phone number changes or you do not continue to own and control the device assigned by your carrier to the number you provided us by contacting us at 917-661-4500.
The Program may not be available in all areas. You understand that message and data rates may apply and your carrier may charge you or deduct usage credit from your account when you text us or we text you and you consent to that. You represent and warrant that you are the age of majority where you reside (18 in most states) and you reside in the U.S. and are using a U.S. mobile number to subscribe. Carries are not liable for delays or undelivered messages. The Program may not be supported by all carriers and all devices.
Forum Selection/Jurisdiction.
Jurisdiction and venue for any controversy, allegation, or claim arising out of or relating to the Program, these Program Terms or any applicable additional or different terms and/or conditions that may apply, in some instances, to your use of the Program or to a service or product offered via the Program, shall be in New York, New York. You and we submit to personal jurisdiction and venue in New York, New York for any and all purposes.
Privacy Policy

Legal Services NYC (“LSNYC,” “we” or “our”) respects your privacy. This LSNYC Access Line Text Message Privacy Policy (the “Text Message Privacy Policy”) describes the information we may collect from you and our practices for collecting, using, maintaining, protecting, and disclosing that information when you use our text messaging communications service (the “Text Message Program”). We will only use our Text Message Program to send you appointment confirmations and/or referrals to other legal services.
This Text Message Privacy Policy does not apply to our data collection activities outside of our Text Message Program or the data practices of any third parties. Please review those privacy policies for additional information.
In addition, please review LSNYC’s Access Line Text Message Program Terms above, which also apply to our Access Line Text Message Program.
By using the Access Line Text Message Program, you acknowledge this Access Line Text Message Privacy Policy and agree to our Access Line Text Message Program Terms above, and consent to our collection and use of your information and data, and other activities, as described below.
1. KEY DEFINITIONS
For your convenience, many of the terms we use in this Access Line Text Message Privacy Policy are defined in this Section I:
- “you” means the individual accessing the Access Line Text Message Program.
- “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with, you (e.g., your name and phone number).
- “service providers” means LSNYC’s agents or vendors.
2. INFORMATION WE COLLECT
We collect several types of personal information from and about you, including:
- Phone number.
- The contents of the message that you send to us.
Below are some examples of how LSNYC may collect personal information:
- Directly from you when you provide it to us.
- Automatically as you engage with LSNYC’s Access Line Text Message Program.
(a) Information About You That You Provide
Please do not reply to our text messages other than to opt-out.
(b) Information Collected Automatically
LSNYC may also automatically collect certain information about you when you access or use the Access Line Text Message Program. We may use automatic data collection technologies to collect certain information about your mobile device when you interact with the Access Line Text Message Program. Such information may include your telephone number and mobile telephone carrier.
3. HOW WE USE THE INFORMATION WE OBTAIN
LSNYC may use information about you for the following purposes, and other purposes as permitted by law:
- to provide you with information or services that you have requested or agreed to receive, including to send you text message communications;
- to prevent unauthorized, improper or illegal activities within the Access Line Text Message Program; and
- to carry out our obligations and enforce our rights.
4. INFORMATION WE SHARE WITH THIRD PARTIES
Except as noted above, LSNYC does not disclose or share your personal information with third parties or affiliates. Your consent to our Access Line Text Message Program (ie. text messaging originator opt-in data and consent) will not be shared with third parties or affiliates.” However, subject to restrictions under applicable law, our service providers may use your personal information to provide services for us and may engage their own vendors to help perform services for us related to the Access Line Text Message Program.
5. CHOICES PROVIDED TO YOU REGARDING YOUR PERSONAL INFORMATION
Please contact us to correct or update your personal information, or to opt-out of the Access Line Text Message Program. Further, we reserve the right to retain data (i) as required by applicable law; and (ii) for so long as reasonably necessary to fulfill the purposes for which the data is retained as permitted by applicable law.
6. DATA SECURITY AND MONITORING
We aim to incorporate commercially reasonable and appropriate safeguards to help protect and secure your personal information. However, no data transmission over mobile networks, wireless transmission or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure the security of any information you transmit to us, and you use the Access Line Text Message Program and provide us with your information at your own risk.
7. UPDATES TO OUR Access Line TEXT MESSAGE Privacy POLICY
We reserve the right to change this Access Line Text Message Privacy Policy from time to time, and it will be prospectively effective upon the posting of the revised Access Line Text Message Privacy Policy. Your use of the Access Line Text Message Program indicates your acknowledgement to the privacy policy posted at the time of use. To the extent any provision of this Access Line Text Message Privacy Policy is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
