Legal Services NYC Responds to Union Strike Vote

We are disappointed that the Legal Services Staff Association (LSSA) voted to strike rather than accept our proposal to respond to a 50% drop in Federal funding ($8 million total) with necessary changes to healthcare and retirement programs. Without those changes, we will be forced to lay off as many as 50 people by the end of 2014.

Effective May 16, LSSA’s 220 members will be on the picket line instead of in the courts and offices fighting for their clients.

A strike is not good for our staff, our clients or their communities. We are very hopeful that we can return to the bargaining table quickly and resolve this impasse to restore programs like foreclosure prevention and immigration assistance for the New Yorkers who depend on us.

In the interim, please know that all of our offices will remain open. We have put into place very detailed plans to ensure continued services to clients.

Low-Income, Elderly Harlem Tenants Fight Back Against Harassment by Landlords

April 9, 2013, Harlem, NY—A group of low-income, elderly tenants are going to court to bring a stop to a long term, sustained harassment campaign started by their landlords in order to get higher rents. The tenants are represented by Manhattan Legal Services (a program of Legal Services NYC) and DLA Piper (Stephen Davidson and Capricci Barush, serving as pro bono counsel).

April 5, 2013, Brooklyn, NY—Tenants and advocates in Coney Island today announced legal action against a landlord who has failed to repair an elevator damaged by Superstorm Sandy, leaving several disabled and mobility-impaired tenants effectively stranded in their apartments for months.

Legal Services NYC Files New Federal Suit against NYPD

Civil Rights Action Filed on Behalf of Limited English Proficient New Yorkers
March 21, 2013, New York, NY—Legal Services NYC announced today that it has initiated a civil rights action against the NYPD regarding their routine discrimination against immigrant New Yorkers who seek police assistance in times of crisis.  This lawsuit is brought in Federal court on behalf of five limited English proficient (LEP) survivors of domestic violence and crime victims who have been denied interpretation by the NYPD, and thus denied access to vital police services, all in violation of federal and City laws.

LSNYC Files Federal Lawsuit against NYCHA on Behalf of Domestic Violence Victims

March 19th, 2013, New York, NY—Legal Services NYC-Bronx and Queens Legal Services today announced the filing of a new federal lawsuit that seeks to reform the New York City Housing Authority’s treatment of domestic violence victims who are seeking emergency public housing in order to escape from their abusers.

1st Dept Reverses Prior Decisions in Major SBLS Victory

March 5, 2013, New York, NY—The NYS Supreme Court Appellate Division, First Department, today reversed two of its own prior decisions and held that prevailing parties in New York State can collect legal fees under the "catalyst theory", unlike federal litigants who are bound by the U.S. Supreme Court’s decision in Buckhannon. The decision was a major victory which will help to alleviate the crisis caused by the lack of availability of counsel to represent low-income New Yorkers. The petitioner was represented by Peter Kempner of South Brooklyn Legal Services, a program of Legal Services NYC.

MLS Wins More than $110 Thousand for Client Who Was Denied Wages

March 5, 2013, New York, NY—Manhattan Legal Services Senior Staff Attorney Julia Rosner filed a complaint with the Department of Labor to obtain unpaid wages for our client, Mr. H, in 2006, and has advocated vigorously on his behalf for the past six years. Mr. H was a delivery man for a supermarket which advertised free delivery services on its bags and elsewhere. The employer had Mr. H bag groceries as he waited for delivery orders, but never paid him an hourly wage in the six years he worked there. Customers often tipped him with food stamps.

Homes Underwater: Forbearance Alternatives for Sandy Homeowners

February 22, 2013, New York NY—Legal Services NYC has published Homes Underwater: Forbearance Alternatives for Sandy Homeowners, a white paper examining the effectiveness of the mortgage relief programs offered by the major lenders in the aftermath of Superstorm Sandy. Immediately after the storm, many lenders publicized programs offering homeowners short-term forbearance periods for their mortgage payments. For homeowners facing massive damages to their homes and a complex web of disaster assistance applications and insurance claims, these announcements promised much needed relief—particularly for those homeowners who are incurring rental costs on top of their mortgage because their home was rendered uninhabitable. In reality, however, the forbearance programs offered to date have failed to provide homeowners with meaningful relief. Indeed, they create a situation where a homeowner is likely to fall into delinquency and may well lead to foreclosure.
